Supreme Court limits drug-sniffing dog use

The use of a drug-sniffing dog by police outside of a home where they suspected drugs were being grown constitutes a search under the Fourth Amendment, the Supreme Court said in a decision handed down Tuesday.
The case, Florida v. Jardines, dealt with whether police could use trained canines to investigate the immediate surroundings of a home for drugs they suspected were being grown inside, but could not see.

Officers from the Miami-Dade Police Department approached Joelis Jardines’ home with a drug dog in 2006 after receiving a tip that marijuana was being grown in the house. The animal alerted officers to the presence of marijuana in the house, after which officers obtained a search warrant and discovered the plants.
The justices affirmed the Supreme Court of Florida’s decision to suppress the evidence by a 5-4 vote. Justice Antonin Scalia delivered the court’s opinion.
“To find a visitor knocking on the door is routine (even if sometimes unwelcome); to spot that same visitor exploring the front path with a metal detector, or marching his bloodhound into the garden before saying hello and asking permission, would inspire most of us to – well, call the police,” Scalia wrote.
This is the second of two police dog cases the court has delivered opinions on this term, both originating in Florida. In a February decision in the other case, Florida v. Harris, the court ruled that an alert by a trained police dog gave police officers probable cause to further search a vehicle.

Phoenix mother accused of abusing her young son

PHOENIX (AP) - Authorities say a Phoenix woman is in custody for allegedly abusing her 2-year-old son.

Phoenix police said Monday that 21-year-old Rickesha Jovani Burns is being held without bond on suspicion of sexual conduct with a minor and child abuse.

Police officers were called to a residence about 8 p.m. Sunday and found Burns holding her son.

They say the child was crying and bleeding and was immediately transported to a Phoenix hospital.

Police say Burns told them her son had been playing with a 12-year-old boy at a park and he had done something to the child.

Doctors say the child had injuries around his rectal area and he needed surgery to remove a foreign object.

Police say they found no evidence that the child was assaulted at the park.

PHOENIX (AP) - A proposal moving though the Arizona Legislature would require divorced Arizona parents who just want to move across town to file court notices and notify the parent who doesn't have custody of their child 60 days before to give them time to object.

The bill would replace a current law that only requires the notifications if the move is out of state or more than 100 miles away.

Proponents say that rule has been abused in some cases by parents who make a series of moves and doesn't take into consideration the effect on parenting time a move of much less distance can mean.

Opponents argue it could affect the ability of a custodial parent to take a new job or buy a house.

(Source: Tucson Police Department) TUCSON, AZ (Tucson News Now) - A 4-year-old boy has died from his injuries after an alleged abuse incident and the boy's mother and her live-in boyfriend have been charged with murder, police say. According to a news release from the Tucson Police Department, 26-year-old Judy Minley and 27-year-old James Dwight Robinson have each been charged with first-degree murder after the child died on Saturday. Minley and Robinson were arrested Friday after a 911 call that reported the boy had drowned. Police say rescuers revived him, but could find no signs that he had been in water. They found severe bruising on his body and determined that the injuries were non-accidental in nature. Minley and Robinson were booked into the Pima County Jail on Friday, originally facing one count of child abuse. According to a news release from the Tucson Police Department, the incident happened at an apartment in the 5400 block of East Williams. Emergency personnel from the Tucson Fire Department responded to the call just before 11 a.m. and found the child unconscious and unresponsive. The release says detectives investigating the case learned that Minley and Robinson allegedly disciplined the boy over several hours before putting him to bed on Wednesday night. On Thursday morning, he was found unresponsive, the release said. Childrens Rights

Children's Rights law exists to safeguard children, their wellbeing and their individual rights. These federal and state policies and laws were spearheaded by the children’s rights movement which promotes legal defenses and protections for children by addressing their social welfare; health, education and special needs; child trafficking; child labor and exploitation and how the juvenile justice system deals with minors. With regard to child labor, the Fair Labor Standards Act (FLSA) protects child laborers, along with other groups. However, because it was enacted when family farms were much more prevalent, the restrictions on agricultural work for children were fairly lax, and continue to remain so. Under general child labor FLSA rules, children under 13 cannot work and children of 14 and 15 years can only work during certain hours for a limited time period. But children who work in an agricultural setting may do so at the age of 9 years if they have signed parental consent. Various organizations have urged the U.S. government to make revisions to the FLSA to address these issues, Human Rights Watch among them. Most recently, they backed legislation known as the Children’s Act for Responsible Employment Act (CARE Act) in 2009, which called for amendments to the FLSA that would, among other things, prohibit minors from working on farms unless employed by their parents, but it never became law. The American Civil Liberties Union (ACLU) is well known as the leading organization supporting the preservation of individual human rights. Amanda told her story in the heart-wrenching video that chronicled her nightmare: the taunts, the beating, the cyber-stalker who tracked her down whenever she tried to start afresh at a new school — firing off images that captured her showing off her young body, flattered by online attention from someone she thought was a kid just like her. Amanda killed herself this week, one month shy of her 16th birthday and one month after telling the world through a YouTube video of bullying that left her depressed and despairing. It is a story no mother wants to tell. “Amanda was a very caring individual. She would help others who needed help,” Carol told The Vancouver Sun during an exclusive interview Friday at her home, where she was surrounded by friends and family. “One of Amanda’s goals was to get her message out there and have it used as a learning tool for others.” As a teacher in the Coquitlam school district and a specialist in assistive technologies, Carol is comfortable around computers and knows well the dangers the online world can hold. Still, she wasn’t able to protect her child. “I have lost one child, but know she wanted her story to save 1,000 more.” Amanda was 12 years old when she made a mistake that would haunt her until her death three years later. Her ordeal started while she was fooling around online with friends. She probably didn’t think it was risky behaviour when she lifted her top to flash the person who was flattering her at the other end of the webcam. Amanda’s moment of indiscretion was not unusual for someone her age: Sexting and using webcams to share sexual photos is a growing trend among children, some so young they are still in grade school. “The Internet stalker she flashed kept stalking her,” said Carol. “Every time she moved schools he would go undercover and become a Facebook friend. What the guy did was he went online to the kids who went to (the new school) and said that he was going to be a new student — that he was starting school the following week and that he wanted some friends and could they friend him on Facebook.” “He eventually gathered people’s names and sent Amanda’s video to her new school.” The video and photos went to teachers, to parents, to Facebook friends, which lead to repeated taunts: “Oh, there’s the porn star.” “It increased her anxiety and she couldn’t go to class,” Carol said. In putting together her video, which Amanda did on her own, Carol said her daughter wanted to help other young people who are being bullied and to bring attention and education to the problem in the hope of seeing it eradicated. “Amanda wanted to tell her story to help other kids. I want to tell my story to help parents, so they can be aware, so they can teach their kids what is right and wrong and how to be safe online,” she said. “Kids have iPads, they have smartphones, technology is much more accessible than it was even five years ago — that is the dangerous factor.” When Amanda’s story and video went viral this week, the outpouring of grief from local teens left Carol unable to distinguish Amanda’s true friends from those who may have helped drive her to suicide. Carol has launched a trust fund in Amanda’s memory to raise money for anti-bullying awareness education and for support programs for youth with mental health issues. Amanda was the victim of unrelenting blackmail. And the cyberspace stalker was aided by people in Amanda’s real-world life — kids who would share the photos on their cellphones, kids who would gang up to hurl first verbal abuse and then fists at her. “Everything she said in the video happened over the past two years,” said Carol. “It was horrendous. I think about it now and I think, ‘Oh my God. How did she survive this long with the pain?’ ” The end, when it came, was a shock. Despite Amanda’s earlier suicide attempts, Carol said in recent days and weeks she was getting much better. She spent time in hospital in September, getting treatment and counselling. Her life was starting to return to normal, which it hadn’t been since grade 8. “She felt like a normal teenager, she was so proud of herself,” said Carol. “She went out with friends, she went to the mall, she said to me, ‘Mom, this is the first time that I feel normal again. I have had the best day ever.’” Carol doesn’t know what caused her daughter’s setback, but Amanda may have given Carol an answer in a private video. “She left me a video message on her phone. I’m not ready to look at it yet,” said Carol. “The coroner has told me it will provide closure for me but I can’t look at it yet.” Carol doesn’t know what happened, but sometime earlier this week — before Amanda killed herself late Wednesday afternoon — something happened to shatter that fragile recovery. The police have been unable to track her stalker down. “The police investigated and investigated, it got traced to somebody in the United States,” said Carol. “But they never found him. Those people are very good at hiding their tracks.” The suspected pedophile threatened that if she didn’t do a show for him, he would circulate her pictures again. Amanda wouldn’t bow to the pressure and he carried out his threat. Finger-pointing at schools for not stopping bullying only angers Carol. She said Amanda, who had learning problems, had excellent support in the Coquitlam school district, where Amanda spent most of her school time. Since March, she was a student at CABE, Coquitlam Alternate Basic Education secondary school, which is a haven for youth who, for whatever reason, need the alternative learning situation. It was there that Amanda made friends, among both the students and staff. “She had a good support network there,” said Carol. Among the teachers Amanda especially liked was former Olympic track and field star Leah Pells, who teaches physical education at the school. “She and Amanda clicked and Amanda trusted her,” said Carol. Carol is much more tech savvy than the average parent. But Amanda’s victimization at the hands of the stalker led Carol to learn more about the horrifying world of child pornography, where some victims don’t even know their images are being shown on porn sites. “You’ll see pornography and the girls are so young,” she said. “I don’t know if the girls are doing this for kicks, if their parents are monitoring it or if they even know about it. All I had to do for that background check was go to the lady I know at the school, and she has the program to run the prints from her computer there, and it's sent off to BCI, and then comes back. Maybe someone from the school can run them for you? Everyone who works in the schools here are required to do the BCI and FBI, it might be worth a try? Also here, the BCI, and FBI fingerprints are separate from the Child Abuse and Neglect Registry here. I can not get a copy of my report by calling or anything, but I could if sent them a request, then they would mail me a copy of what's on there. I know what CPS did to us, and I know I am on there for sure. It burns me to even think about that. Child Abuse and Neglect Information System (CANIS): CANIS was the child welfare agency's administrative system for cases investigated due to allegations of abuse or neglect. Information on open cases was transferred to OASIS in July 1999. System officials in Fairfax emphasized that neither this system nor paper files will contain a full record of abuse and neglect allegations and findings due to state regulations on expunging files effective in 1995. Since that time, information on unfounded allegations is to be purged one year after the incident if no other incident is reported. Depending on the severity of the level of risk established during the investigation, information on founded allegations is to be purged between 3 to 18 years after the incident. OASIS: OASIS came on line in November 1997 and was designed to consolidate all child welfare cases into one data base. State and local administrative and casework staff reported that the system faced a series of administrative and programming challenges for the first several years of operation. Reportedly, caseworkers and clerks found data entry to be very difficult and time consuming relative to the older system. In addition, quality control measures were obstructed by challenges in producing reports. Line staff reported that data on cases entering the system in the past two years is reliable - but encouraged the study team to use paper records to gather case level data prior to that time. Child Welfare Case Records: Casework supervisors and staff in Fairfax reported that case records were the best source of consistent and reliable information on reason for placement, service referrals and receipt, reason for case closure and type of permanent placement. The foster care plan would be the best source for this information in the file. The plan is updated every six months and includes each of these data elements except date custody was transferred and permanent placement at case closure. These data elements should be recorded at the end of the case notes. The study team was cautioned however, that case records, especially in Fairfax, are very detailed. It took state staff, familiar with the records and forms an average of eight hours to review each record during the state's trial runs for the Child and Family Services Review. Mother, friend charged with 1st-degree murder

Police suspect that Kristepher Benavidez, 25, had been allegedly physically abusing the twins who were hospitalized after suffering severe injuries. Police say Monique Gaxiola, 30, knew about the alleged abuse, but didn't report it. According to police, one of the twins has died, prompting the new charges. Kristepher Benavidez, 25, and Monique Gaxiola, 30, were booked into Pima County jail. Each faces two counts of child abuse, Sgt. Chris Widmer, spokesman for the Tucson Police Department, said in a news release. Tucson Fire Department personnel went to a home in the 5200 block of South Newcastle Court near South Midvale Park Road, in response to a child not breathing call about about 2:30 p.m. Wednesday. While they took the toddler to a hospital, police officers discovered the toddler’s twin and a 7-year-old sister at a neighbors home. While the older child appeared uninjured, the twin girls suffered “injuries that appeared non-accidental,” Widmer said. Detectives “determined that the father had been physically abusing the twin 18-month old sisters for an unknown period of time. The mother was aware of the abuse but did not report it. Both children suffered severe trauma from the abuse,” Widmer said in the release. The oldest child is in the custody of state Child Protective Services. The twins remain hospitalized. Bond for Benavidez was set at $20,000, while it is $5,000 for Gaxiola.
